TOWN OF CLAY PUBLIC HEARING NOTICE

PLEASE TAKE NOTICE that there has been introduced before the Town Board of the Town of Clay, County of Onondaga and State of New York, on the 3rd day of September 2008 proposed Local Law No. 8 of the Year 2008, “LOCAL LAW NO. 8 OF THE YEAR 2008 Amending CHAPTER 105 entitled ‘FEES’, § 105.4 A. Fees derived from Code Sections, Chapter 81, Building Construction and § 105.4 B. Additional Fees, Subparagraphs (2) and (3) by amending, increasing and adding fees charged by the Department of Planning and Development, as well as the Town Board for special district improvement fees to the Code of the Town of Clay.

The purpose of this proposed local law 2008-08 is to amend CHAPTER 105 entitled ‘FEES’, § 105.4 A. Fees derived from Code Sections, Chapter 81, Building Construction and § 105.4 B. Additional Fees, subparagraphs (2) and (3) by amending, increasing and adding fees charged by the Department of Planning and Development, as well as the Town Board for special district improvement to the Code of the Town of Clay with respect to zone change applications, variances (residential, commercial and after construction), Special permits, site plan and special permits requiring site plan review, amended site plans, amendment of site plans which are proposed within five years of the original approval, preliminary plats (base fee $200.00 plus $50.00 per lot); base fee, zoning information research, Fire Safety/property maintenance, inspection required by NYS Uniform Fire Prevention and Building Code; Buildings and/or leased spaces; administrative fee with regard to certificates of occupancy, subdivisions, and site plans, also computer-projected images at public meetings, additional advertising that does not include Town Board zone changes, additional engineering fees incurred by the Town for unusual site plans and other matters, and increasing the fee structure for Town Board service for special district improvements due to increase in costs and excessive inspections etc., due to lack of experience or faulty workmanship upon inspections of developers’ site, review of plans and the increase in cost of living.

PLEASE TAKE FURTHER NOTICE that pursuant to Section 20 of the Municipal Home Rule Law, a public hearing will be held on the aforesaid proposed local law before the Town Board of the Town of Clay at the Town Hall of the Town of Clay, located at 4401 State Route 31, Clay, New York, on the 15th day of September 2008, commencing at 7:38 P.M., local time, at which time all interested persons will be given an opportunity to be heard.
